Licence Agreement:   Personal and Educational use only

As used in this Agreement, the term "Product" shall mean the ArmTCP package, and the term "Licensor" shall mean the author and copyright holder of the Product, Mr Ajith Ponnampalavanar. If any third party software is included as part of the Product, permission has been obtained from the Licensor of that software to redistribute it as part of the Product under this Agreement. Any License Agreements governing the use of these third party software is included as part of the documentation of the Product. If a separate Agreement is not included for any third party software, then the use of that third party software shall be governed by this Agreement, but the term "Licensor" with respect to such third party software, shall mean the manufacturer of that software.


Disclaimer:

The Product is provided on an "AS IS" basis, WITHOUT WARRANTY of any kind, including without limitation the warranties that it is free of defects, merchantable, fit for a particular purpose or non-infringing. The entire risk as to the quality and performance of the Product is borne by Licensee. Should the Product prove defective in any respect, Licensee and not Licensor or its suppliers or resellers assumes the entire cost of any service and repair. In addition, the security mechanisms implemented by the Product have inherent limitations, and Licensee must determine that the Product sufficiently meets its requirements. This disclaimer of warranty constitutes an essential part of this Agreement. No use of the Product is authorized hereunder except under this disclaimer.


Limitation of Liability:

In no event will Licensor or its suppliers or resellers be liable for any indirect, special, incidental or consequential damages arising out of the use of or misuse of the Product, even if advised of the possibility of such problems. In any case, Licensor's entire liability under any provision of this agreement shall not exceed in the aggregate the sum of the fees Licensee paid for this license (if any). Licensor is not responsible for any liability arising out of content provided by Licensee or a third party that is accessed through the Product and/or any material linked through such content.


Personal and Educational License:

The Product is a commercial product, however Licensor grants Licensee a non-exclusive and non-transferable license to use for Personal or Educational purposes the executable code version of the Product, provided that the following terms are satisfied:

1. Licensee may not customize or redistribute the Product in any form (including but not limited to distribution via disks, CDs, Magazines, BBS, Web Sites, or FTP Sites, free of charge or otherwise), unless the Licensee has specifically obtained a written permission. If you wish to obtain such permission, contact the Licensor with details.
   
   
2. Licensee may not modify or create any derivative works of the Product or documentation, including translation or localization.
   
   
3. Licensee may not decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the Product.
   
   
4. Licensee may not redistribute, sell, rent, lease, sublicense, or otherwise transfer rights to the Product.
   
   
5. Licensee may not remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the Product.
   
   
6. Licensee may make copies of the Product for backup purposes. Licensee must make sure any such copy contains all of the original Copyright notices and Licence Agreements.
   
   
7. Licensor may terminate this Agreement if Licensee breaches any of its terms and conditions. Upon termination, Licensee shall destroy all copies of the Product.
   
   
8. The Licensor reserves all rights to the Product. The Product is protected by copyright and other intellectual property laws.
